This agreement constitutes a contract between guest and Sharon & Richard Shutts, (owners of unit # 7).

DEPOSIT: A deposit of 2 night rent confirms the reservations. The balance of the total rental fee is due on or before 60 days before arrival. In event the reservation is made less than 60 days prior to arrival, full payment is expected at time of booking. There is a $50 service charge on returned checks

CANCELLATION: For a deposit refund, less $100 processing fee, cancellations is required 60 days or more prior to arrival date. For cancellations received within 60 days of arrival or after arrival date, deposit of 3 nights will be held and any balance will be refunded.

Equipment occasionally malfunctions and cannot be guaranteed 100% of the time.  Assistant to owner will correct the problems as soon as humanly possible. An authorized employee or repairman may enter the premises to repair such equipment.  Refunds will not be issued due to malfunctioning equipment including Internet access. Kihei is a desirable developing area. Owners/assistant will always try to inform guests of any construction that they are aware of but will not give refunds due to construction noise.

Guest assume responsibility for any loss or damage to this property or its contents, due to negligence or misconduct on the part of the guest or their invitees. An inventory is conducted by assistant at the beginning of each stay and again at the end of the stay prior to cleaning.

All properties are non-smoking including on the lanai.

Lock all doors when leaving premises. Do no leave money or valuables unattended. Neither assistant nor owners will be held liable for any theft or valuables left behind.

Occupancy and use of premises and communal areas shall not be such to disturb other guest or residents. Assistant has the right of entry to inspect owner’s property at times deems necessary.  The assistant has the prerogative to terminate this agreement and direct disruptive guests to vacate premises without issuing refunds.

Guests may not hang towels, garments, etc. from balconies

Should guest have a lock out after hours, there will be a $50 charge to be paid to assistant promptly upon re-entry to the unit. The cost for lost keys is $25.00 each.

Only designated “beach towels” can be taken outside of the unit for beach use.

The unit is not available for rent to students or guest under the age of 25.  The person signing this agreement must occupy the premises the entire length of the reservation.  Failure to adhere to this regulation will result in immediate termination of this Agreement and/or eviction.

Neither the assistant nor the owners will be held liable for any accident or injury that may occur to Guest or their invitees during occupancy in or on the property.





An electronic contract is a legal contract according to Electronic Signature in Global and International Commerce Act (ESGICA)
